 1. Introduction

Welcome to BY MB Consultancy. We are a registered business in Bahrain with Commercial Registration Number 75296-2. Our address is 862 Road 2620 Block 226, Muharraq, Bahrain. By using our website www.by-mb.com or purchasing our services, you agree to comply with these Terms and Conditions.

1.1 Definitions

  • Sole Proprietorship: BY MB Consultancy operates as a Sole Proprietorship under a Sijili license in the Kingdom of Bahrain.
  • Data Processor: BY MB Consultancy acts as a Data Processor for configuration purposes only. We do not store, archive, or retain client data, including visual data (e.g., CCTV feeds), on our servers.
  • Intelligence Triangle: A proprietary framework used by BY MB Consultancy to standardize client deliverables, ensuring premium service quality and operational excellence.

2. Use of the Website

You agree to use the Site only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use and enjoyment of the Site.

3. Goods and Services

We offer a variety of solutions and services, including smart home automation, consultancy, integration services, and the sale of related products. Service delivery and product shipping details will be arranged directly with the buyer upon booking or purchase.

3.1 Scope of Services

BY MB Consultancy provides strategic operational advice, technology integration, and consultancy services. We do not act as a hardware retailer but as an Intelligence Agency, delivering tailored solutions using the BYMB Intelligence Triangle framework. Our services include:

  • Smart home automation and consultancy.
  • Integration of security and surveillance systems.
  • Customized technology solutions for residential and commercial clients.

All services are delivered in compliance with Bahrain’s Personal Data Protection Law (PDPL) and Ministry of Interior (MOI) regulations.

4. Payment Options

We offer multiple payment methods for your convenience, including:

  • Cash
  • Checks
  • Benefit
  • Visa/MasterCard
  • Online payments
  • Direct bank transfer
  • Payment links

5. Cancellations and Refunds

You may cancel or reschedule your service at least 48 hours before the scheduled time without any charges. Cancellations made within 48 hours of the scheduled service will incur a cancellation fee of 50 BHD.

5.1 Credit Policy

  • Audit Fee Credit: Clients who undergo an operational audit by BY MB Consultancy are eligible for a BHD 150 credit, valid for 90 days from the date of the audit report.

    • The credit can be applied as a discount on the final invoice for hardware purchases exceeding BHD 500.
    • The credit is non-transferable and has no cash redemption value.
    • Unused credits expire after 90 days.

6. Limitation of Liability

The Client acknowledges that BY MB Consultancy provides strategic operational advice and technology supply only. BY MB Consultancy explicitly disclaims liability for any of the following:

  • Criminal acts, theft, or property loss occurring at the client’s premises.
  • Any indirect, incidental, special, or consequential damages arising from the use of our services or products.
  • Damages resulting from the misuse or improper installation of products or systems by the client or third parties.

Our total liability for any claim is strictly limited to the fees paid for the specific service rendered.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain.

7.1 Force Majeure

BY MB Consultancy shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions if such failure or delay is due to unforeseen circumstances, including but not limited to:

  • Natural disasters, acts of God, or extreme weather conditions.
  • Government actions, strikes, or labor disputes.
  • Network or system failures beyond our control.

In such events, BY MB Consultancy will use reasonable efforts to resume services as soon as practicable.

9. Dispute Resolution

Any disputes arising from these Terms and Conditions shall first be addressed through direct negotiation between the parties. If unresolved, disputes shall be referred to the courts of the Kingdom of Bahrain for resolution.

10. SEVERABILITY (Amendment #1)

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

11. ARBITRATION (Amendment #2 - Replaces old Dispute clause)

Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under the arbitration rules of the Bahrain Centre for Dispute Resolution (BCDR), which rules are deemed to be incorporated by reference into this clause.

12. INSURANCE REQUIREMENT (Amendment #5)

For commercial projects with a total value exceeding BHD 2,000, the Client agrees to maintain comprehensive general liability insurance and name BYMB Consulting Services as an Additional Insured for the duration of the project.
